Welcome to MiSQue. MISQUE LTD, trading as MiSQue, operates this website and online store. The terms “we”, “us” and “our” refer to MISQUE LTD.

We provide the information, content, features, products and services available through this website (the “Services”). Our online store is powered by Shopify.

These Terms of Service, together with the policies referred to within them, explain the terms that apply when you visit our website or purchase from MiSQue.

Nothing in these Terms affects your statutory rights as a consumer.

By using our Services or placing an order with us, you agree to these Terms of Service and our Privacy Policy.

1. Using Our Website

You may use our website only for lawful purposes.

When providing information to us, including when placing an order or creating an account, you agree that the information supplied is accurate, current and complete.

You are responsible for maintaining the confidentiality of any account credentials associated with your use of the Services.

2. Our Products

MiSQue products are made to order.

We make reasonable efforts to display our products, colours, artwork and product information accurately. However, colours and appearance can vary depending upon your screen, device and display settings.

Minor variations may also occur as a result of the printing and manufacturing process.

We may change or discontinue products, designs, colours, sizes or other options without prior notice.

3. Orders

When you place an order, you are offering to purchase the selected products from MiSQue.

Your order is accepted when we confirm acceptance of it. Payment must be successfully authorised before an order can be processed.

Because our products are made to order, production may begin shortly after an order is placed. If you need to change or cancel an order, please contact us as soon as possible. We cannot guarantee that changes can be made once production has started.

We reserve the right to decline or cancel an order where reasonably necessary, including where there has been an obvious pricing error, payment cannot be authorised, a product is unavailable or we suspect fraudulent activity.

If we cancel an order after payment has been taken, we will refund the appropriate amount.

4. Prices and Payment

Prices displayed on the MiSQue website are shown in the applicable store currency.

Any delivery charges applicable to your order will be displayed before you complete checkout.

We may change our prices from time to time, but changes will not affect orders that have already been accepted.

Promotional offers and discount codes may be subject to additional terms and may be withdrawn or changed at our discretion, subject to applicable law.

5. Shipping and Delivery

MiSQue products are made to order and therefore require production time before dispatch.

Estimated processing and delivery information is provided on our website and/or during checkout.

Delivery dates are estimates rather than guaranteed dates. Occasionally delays may occur because of circumstances outside our reasonable control.

Once your order has been dispatched, tracking information will be provided where tracking is available.

For UK consumer orders, responsibility for the goods remains with MISQUE LTD until the goods are delivered to you, or to another person identified by you to receive them, except where you independently arrange your own carrier.

6. Returns, Refunds and Consumer Rights

Returns, refunds and cancellations are handled in accordance with our Returns & Refunds Policy and applicable consumer law.

Nothing in these Terms is intended to exclude or restrict any statutory rights you may have as a consumer.

If an item arrives damaged, faulty, defective or materially different from what you ordered, please contact us so that we can resolve the issue.

7. Intellectual Property

Unless otherwise stated, the MiSQue name, branding, logos, artwork, designs, photographs, graphics, text and other original content appearing on this website are owned by or licensed to MISQUE LTD and are protected by applicable intellectual property laws.

You may use our website for your personal, non-commercial use.

You must not reproduce, distribute, modify, commercially exploit or otherwise use MiSQue intellectual property without our prior written permission, except where permitted by law.

Shopify and other third-party names, trademarks and intellectual property appearing through the Services remain the property of their respective owners.

Our website may use or link to services provided by third parties, including payment providers, fulfilment providers, delivery providers and other services necessary to operate our store.

We are not responsible for the content of independent third-party websites.

9. Shopify

Our online store is powered by Shopify, which provides the ecommerce technology that enables us to offer our products and Services online.

Purchases made from the MiSQue store are transactions between you and MISQUE LTD, not Shopify.

Your personal information may be processed by Shopify as described in our Privacy Policy and Shopify’s applicable privacy information.

We process personal information in accordance with our Privacy Policy.

Where such an event materially affects your order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.

Your statutory rights remain unaffected.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed to the minimum extent necessary.

The remaining provisions will continue in effect.

The version applying to an order will normally be the version in force when that order was placed.

If you are a consumer living elsewhere in the United Kingdom, you may also benefit from mandatory protections provided by the laws applicable where you live.

Nothing in these Terms removes any rights you may have to bring proceedings in a court available to you under applicable consumer law.
